Your Rights by Country

EVParto sells from Hong Kong to customers all over the world. Our Terms of Service are governed by Hong Kong law, and clause 18 of those terms says something important: where the law of your own country gives you consumer rights that are stronger than these terms, those rights apply to you in full and nothing in our terms takes them away.

This page sets out, market by market, what those rights are. It is part of the Terms of Service and is written to be read alongside them. Where this page and the Terms differ, this page wins for customers in the country concerned.

Everyone, everywhere, also gets our own voluntary commitments: a 30-day return window and a 24-month guarantee. Where a country gives you longer or more, you get the longer or the more. You never get less.

Europe: the 27 European Union member states

Austria, Belgium, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden.

  • 14 days to withdraw from the contract without giving any reason, counted from the day you or someone you name receives the goods. Where an order is delivered in several parcels, the period runs from the last one. See Right of Withdrawal for how to exercise it, including the model form and the withdrawal button.
  • At least two years of conformity rights from delivery, and longer in several countries. See the table below, which is the one part of this page most sellers get wrong.
  • Prices include VAT for your country wherever we are registered to collect it, shown before you pay.
  • Product safety. Our EU responsible person under Regulation (EU) 2023/988 is named on every product page and on the Product Safety page.
  • Unfair terms. Any term in our Terms of Service that would be unfair under Directive 93/13/EEC does not bind you.
  • Return costs. On withdrawal you bear the direct cost of returning the goods, which is disclosed to you before you order. Where the goods are faulty, damaged or not what you ordered, we bear it.

Conformity rights are not two years everywhere, and we apply the longer period

The European directive sets a floor of two years. Several countries went above it, and you get your own country's period, not the floor.

Country How long you are covered How long we carry the burden of proof
Spain 3 years from delivery, since 1 January 2022 2 years
Sweden 3 years 2 years
France 2 years, and extended by 6 months after a repair The whole 2 years
Portugal 3 years 2 years
Netherlands No fixed cap. Cover runs for as long as you could reasonably expect the goods to last, which for a vehicle part can exceed two years 1 year
Norway and Iceland 5 years for goods meant to last substantially longer than two years. We treat vehicle parts as falling in that class Norway: 2 years. Iceland: as Icelandic law provides
Belgium and Poland 2 years 2 years
Ireland Up to 6 years to bring a claim 1 year
Germany, Austria, Italy, Finland and the other member states 2 years, unless your national law gives more 1 year, unless your national law gives more

Our own 24-month guarantee runs alongside all of these and never replaces them. Where your statutory period is longer, the longer one is the one that counts.

Germany

Because Germany is our largest European market, this section names the German provisions behind the rights above, so that you can check them rather than take our word for it. Our contract is governed by Hong Kong law, and that changes none of this. Article 6 of the Rome I Regulation means a German consumer keeps every mandatory protection of German law whatever law a trader writes into its terms, and we do not argue otherwise.

Your withdrawal right

  • 14 days, no reason needed, under sections 312g and 355 BGB, running from the day you or someone you name receives the goods (section 356(2) BGB). Where an order arrives in several parcels, it runs from the last one.
  • We refund within 14 days of your notice, by the means you paid with, under section 357 BGB. In practice we refund within 5 days of the goods reaching us.
  • The withdrawal button required since 19 June 2026 is in the footer of every page. The model form and every other route are on the Right of Withdrawal page.
  • You bear the direct cost of returning the goods on withdrawal, which is disclosed to you before you order because German law requires that disclosure before the cost can be passed to you. We confirm the exact cost with your return reference, before you send anything.

Your rights if a part is faulty

  • Two years from delivery under section 438(1)(3) BGB. Your remedies are in section 437 BGB: subsequent performance first, then withdrawal from the contract, a price reduction, or damages.
  • Twelve months of reversed burden of proof under section 477 BGB. If a defect shows itself within a year of delivery, the law presumes it was already there, and it is for us to prove otherwise.
  • Our guarantee goes further than that, and this is the part worth reading. Under section 477 BGB the presumption stops after twelve months and the burden moves to you, which is why so many second-year claims fail. For the full 24 months we do not rely on that expiry. We assess your claim on its merits and we do not ask you to prove when the defect started. That is a real benefit beyond the statutory minimum, it is what makes ours a guarantee within the meaning of section 443 BGB rather than a restatement of the law, and it is given by Dragon Wagon Export Limited at the address on the Legal Notice.

Prices, identity and cookies

  • Prices include German VAT wherever we are registered to collect it, shown before you pay, as the Price Indication Ordinance (PAngV) requires.
  • Our full company particulars are published under section 5 DDG on the Legal Notice, including a real postal address and a working email address that a person reads.
  • Cookies are set only with your consent under section 25(1) TDDDG, except those strictly necessary to run the shop, which run under section 25(2). Rejecting is one click, the same as accepting. See the Cookie Policy.
  • Our packaging is licensed in the LUCID register under the Packaging Act, number DE3086523197470. See Packaging and Battery Take-back.
  • Product safety information under Regulation (EU) 2023/988, including our responsible person in the European Union, is on every product page and on the Product Safety page.

Complaints and arbitration

  • Write to contact@evparto.com with "Complaint" in the subject line. We acknowledge within 24 hours, usually sooner, and give you a decision or a clear next step within 14 days.
  • Section 36 VSBG requires a declaration about consumer arbitration only from traders with more than ten employees. We are below that threshold, we are not obliged to take part and we do not. That does not affect your right to go to a court or to a consumer body.
  • The European Union's online dispute resolution platform closed on 20 July 2025 and has no successor. Any shop still linking to it is linking to nothing.

Where German law does not apply

Everything above concerns your rights as a consumer, and those are yours regardless of our choice of law. The internal mechanics of the contract, meaning matters such as the interest rate on an unpaid trade invoice, the notice period a business buyer must observe, and how an obvious pricing error is corrected, are governed by Hong Kong law and are written out expressly in the Terms of Service rather than left to a statute. Nothing in that arrangement reduces a consumer right.

France

  • 14 days to withdraw under article L221-18 of the Code de la consommation, from receipt of the goods.
  • Two years of garantie legale de conformite under articles L217-3 and following, and we carry the burden of proof for the whole two years, not twelve months. French law is more generous than the European floor here and you get the French position.
  • A repair extends your guarantee by six months, and time the part spends immobilised is added back.
  • The garantie des vices caches under article 1641 of the Code civil runs alongside, for two years from discovery of the defect.

Spain

  • 14 days to withdraw under the Ley General para la Defensa de los Consumidores y Usuarios.
  • Three years of conformity cover from delivery, since 1 January 2022, and two years during which we carry the burden of proof. Spain gives you a full year more than the European floor and you get the Spanish position.
  • Our responsible person under the General Product Safety Regulation and our representative under Article 27 GDPR are both established in Madrid. Their details are on the Legal Notice, and you may write to either in Spanish.

Austria

  • The European rights above apply, under the Fern- und Auswartsgeschafte-Gesetz (FAGG) and the Konsumentenschutzgesetz (KSchG).
  • 14 days to withdraw under section 11 FAGG, and two years of Gewahrleistung under the Verbrauchergewahrleistungsgesetz, with twelve months of reversed burden of proof.
  • Our company particulars are published as the E-Commerce-Gesetz (ECG) requires, on the Legal Notice.

Netherlands

  • 14 days to withdraw under article 6:230o of the Burgerlijk Wetboek.
  • There is no fixed guarantee period in Dutch law. A product must do what you could reasonably expect of it, and for a vehicle part that expectation can run well beyond two years. We apply that standard rather than a two-year cutoff.

Italy, Poland, Ireland, Belgium and the remaining member states

  • 14 days to withdraw, and at least two years of conformity cover (in Ireland, up to six years to bring a claim) with at least twelve months of reversed burden of proof (two years in Poland and Belgium), under each country's transposition of the European directives: the Codice del Consumo in Italy, the Ustawa o prawach konsumenta in Poland, the Consumer Rights Act 2022 in Ireland, and the Code de droit economique in Belgium.
  • Where your national law gives more than that, you get the more. Tell us and we will apply it without argument.

United Kingdom

We sell to the United Kingdom through the checkout for baskets above £135 (UK VAT rule; see our Shipping and Delivery policy, 5.3). Where we supply you:

  • 14 days to cancel under the Consumer Contracts Regulations 2013.
  • 30 days to reject faulty goods outright for a full refund under the Consumer Rights Act 2015, followed by the repair, replacement and price-reduction remedies.
  • A fault that appears within six months of delivery is presumed to have existed at delivery. You have up to six years (five in Scotland) to bring a claim.
  • The total price you are asked to agree to is the total price you pay.

Switzerland

  • Swiss law governs your contract with us, not Hong Kong law. Swiss private international law does not permit a choice of foreign law in a consumer contract of this kind, and we do not attempt one.
  • Swiss law gives no general cooling-off right for online purchases. Our own 30-day return window applies to you anyway, on the terms in Returns and Refunds.
  • Prices shown to Swiss customers comply with the Price Indication Ordinance.

Norway, Iceland and Liechtenstein

  • 14 days to withdraw, on the same basis as the European Union.
  • Five years of cover under the Consumer Purchases Act for goods intended to last substantially longer than two years. We treat vehicle parts as falling in that class, so you have five years, not two.

Turkey

  • 14 days to withdraw under the Distance Contracts Regulation.
  • Turkish mandatory consumer rules apply to you regardless of the Hong Kong law clause.

South Korea

  • 7 days to withdraw from receipt, under the Act on Consumer Protection in Electronic Commerce.
  • Three months, or 30 days from discovery, where the goods differ from how they were advertised. In that case we bear the return cost.
  • Korean customs requires a Personal Customs Clearance Code for imported parcels. We ask for it at checkout; without it the parcel cannot clear.
  • Some vehicle parts require KC certification in Korea. Where a part you have ordered is affected, we will tell you before we ship rather than send something that cannot clear.

Taiwan

  • 7 days to rescind from receipt under Article 19 of the Consumer Protection Act, without giving a reason.
  • You bear no cost. Taiwanese law puts the expense of that rescission on us, and we honour it.

Israel

  • 14 days to cancel under the Consumer Protection Law, from purchase or from receiving the disclosure document, whichever is later.
  • We may deduct a cancellation fee of 5% of the transaction or ILS 100, whichever is lower. We do not deduct it where the goods were faulty or not as described.

South Africa

  • 7 days to cancel without reason or penalty under section 44 of the Electronic Communications and Transactions Act, from receiving the goods.
  • Full refund within 30 days. You bear only the direct cost of returning the goods.
  • Section 47 of that Act applies these rights to you irrespective of the law chosen in our terms, and we do not argue otherwise.
  • A six-month implied warranty of quality applies under section 56 of the Consumer Protection Act, alongside our own 24-month guarantee.

Australia

The following statement is required by the Australian Consumer Law and we reproduce it as required:

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

  • Nothing in our Terms of Service excludes, restricts or modifies those guarantees.
  • Australian law gives no general cooling-off right for online purchases. Our own 30-day return window applies to you anyway.

New Zealand

  • The Consumer Guarantees Act 1993 applies to goods we supply to you as a consumer and cannot be contracted out of.
  • No general cooling-off right exists. Our own 30-day return window applies to you anyway.

Canada

  • Provincial consumer protection legislation applies to you and cannot be excluded by our choice of law.
  • Quebec: the Consumer Protection Act prohibits a term imposing a foreign law on a Quebec consumer. Quebec law applies to you.
  • No general cooling-off right exists for ordinary online purchases in most provinces. Our own 30-day return window applies to you anyway.

United States

  • Under the Federal Trade Commission's Mail, Internet or Telephone Order Merchandise Rule, we must ship within the time we stated or, where we stated none, within 30 days, and must offer you the choice of consenting to a delay or cancelling for a full refund.
  • State consumer protection and privacy laws apply to you where their thresholds are met. See the Privacy Policy.
  • Our own 30-day return window and 24-month guarantee apply to you.

Japan

  • Japanese law gives no cooling-off right for mail-order purchases. Our published return policy governs, and it gives you 30 days.
  • The information required by the Act on Specified Commercial Transactions is on the Legal Notice page.

Singapore

  • No general cooling-off right exists for online purchases. Our own 30-day return window applies to you anyway.
  • The Consumer Protection (Fair Trading) Act gives you repair, replacement, price reduction and rescission remedies where goods do not conform.

Saudi Arabia

  • 7 days to terminate from receipt under the E-Commerce Law, provided the goods are unused. That law applies to us whether or not we are established in the Kingdom, and we do not argue otherwise.
  • You may also terminate if delivery takes more than 15 days from the agreed date.
  • Please read this before ordering. Saudi customs requires a conformity certificate for imported goods that we, as a Hong Kong company, cannot obtain. Parcels may be held or refused at the border. We will refund you in full if that happens, but we cannot promise delivery, and we do not quote a firm delivery date for Saudi Arabia.

Brazil

  • 7 days to regret the purchase under Article 49 of the Consumer Defence Code, from receipt.

Mexico

  • 5 working days to cancel under the Federal Consumer Protection Law, from receipt.

China, India, Indonesia and Vietnam

  • These markets impose registration, local-representative, minimum-price or product-certification requirements on foreign sellers. We will tell you before we ship if a requirement affects your order, and refund you in full rather than send something that cannot clear.
  • Local mandatory consumer rights apply to you and are not displaced by our terms.

Everywhere else

  • Hong Kong law governs, as set out in clause 18 of the Terms of Service.
  • Our own 30-day return window and 24-month guarantee apply to you, and any mandatory consumer right your own country gives you applies on top of them.

If your country is not listed, or this page is out of date

Write to contact@evparto.com and tell us what your law requires. We would rather correct this page than argue with you. If you believe we have got something wrong here, that is a complaint and we treat it as one: acknowledged within 24 hours, usually sooner, decided within 14 days.
