Terms of service

Terms of Service
EVParto (A DW-Export Brand), Dragon Wagon Export Limited
Version 5.5, 24 October 2026
Version 5.5, 24 October 2026. These terms apply to every order you place through our online shop www.evparto.com. You complete the order on our checkout pages at checkout.evparto.com, checkout.evparto.de or checkout.evparto.es, which we also operate. Your contracting party is Dragon Wagon Export Limited (details in clause 1). These terms form the contract between you and Dragon Wagon Export Limited.
Please read them before you order. By placing an order you accept them. If you do not accept them, do not place the order.
Nothing in these terms takes away rights the law of your own country gives you as a consumer and cannot allow us to remove. Where any clause here conflicts with a mandatory rule of consumer law that applies to you, that rule wins and the rest of these terms carry on unaffected. Country by country detail is set out in our Your Rights by Country annex, which forms part of these terms.
1. Who you are contracting with
Your contract is with:
- Dragon Wagon Export Limited, a company incorporated in the Hong Kong Special Administrative Region, company number 79920083 (Companies Registry, Hong Kong), also its Business Registration Number.
- Registered office: Room No. 15, Unit 603, 6th Floor, Sunbeam Centre, No. 27 Shing Yip Street, Kwun Tong, Kowloon, Hong Kong SAR.
- Email: contact@evparto.com
- Telephone: +852 5983 2060
EVParto (A DW-Export Brand) is the trading name and the brand under which Dragon Wagon Export Limited sells. "We", "us" and "our" in these terms mean Dragon Wagon Export Limited. "You" means the person or business placing the order.
We sell replacement vehicle parts worldwide. Goods are dispatched from Hong Kong. We are an independent seller. We are not a franchised dealer, an authorised distributor, an agent of any vehicle manufacturer, and we are not affiliated with any vehicle manufacturer. Manufacturer names, model names and original equipment numbers appear on this site only to identify the vehicle a part fits, which is a permitted descriptive use.
Our EU product safety contact and our EU data protection representative is Mario Zaccagnini, Calle de Ayala 112, 3B, 28006 Madrid, Spain, contact@evparto.com. Full details are in our Legal Notice.
2. Which parts apply to you
These terms are written for two different kinds of buyer and it matters which one you are.
- You are a consumer if you are buying wholly or mainly outside your trade, business, craft or profession. Consumers get every protection in these terms and every protection their national law gives them. Clause 16 does not apply to you.
- You are a business customer if you are buying in the course of a trade, business, craft or profession, including garages, workshops, fleet operators, resellers and traders. Clause 16 applies to you and changes several of the rights below. Consumer withdrawal rights and consumer guarantee periods do not apply to business customers.
Your status follows the purpose of your purchase. You declare a business purchase by giving us a VAT identification number for the order, by ordering through our trade desk or against a trade quote, or by telling us in writing that you are buying for your business. By making that declaration you confirm that you are buying for your trade, business, craft or profession. We rely on it: we treat you as a business customer, clause 16 applies, and we invoice and account for tax on that basis. Do not make that declaration if you are buying as a consumer. If you make it and it is untrue, you cannot later rely against us on consumer rights that the law withholds from a buyer who gave a seller acting in good faith the impression of a business purchase, and you must reimburse any tax, duty or cost we incur because of the untrue declaration. A company name or a business delivery address on its own does not make you a business customer, but where you give one we may ask you to confirm your status before dispatch. If you gave business details by mistake, tell us in writing at contact@evparto.com before dispatch and we will record you correctly.
Clauses 4, 6, 8, 9, 10, 15, 17, 18, 19, 21, 23 and 24 apply to everyone.
3. How a contract is made
Every product page, price, listing, search result, feed entry, marketplace listing and advertisement we publish is an invitation to treat. It is not an offer capable of acceptance. Putting an item in your basket does not create a contract, and neither does reaching the payment page.
The steps are these.
- You place an order. That order is your offer to buy the goods on these terms.
- We send an order acknowledgement by email. This confirms we have received the order and taken payment or an authorisation to take payment. It is not acceptance of your offer.
- We accept your offer, and the contract comes into existence, at the moment we send you a dispatch confirmation for the goods. Where an order contains several items, a contract is formed for each item as that item is dispatched, and items not yet dispatched are not yet contracted.
We may decline an order, in whole or in part, before dispatch confirmation. Reasons include an error in the price or description, a part that turns out to be unavailable, a failed payment or fraud check, a delivery address in a country we cannot lawfully or safely ship to, an order that looks placed for resale in breach of clause 16, a screening hit under clause 19, or an order for a part that has no carrier route under clause 10. If we decline, we tell you and refund in full, using the same payment method, without undue delay and in any event within 14 days.
Parts shown without a price are inquiry-only. They cannot be bought at checkout. Ask for a quote and we will reply with a price, a lead time and a validity period. A quote is an offer from us that you can accept within the stated period, and the contract is then formed when we confirm your acceptance in writing.
We keep the text of your order and the version of these terms that applied to it. You can ask us for a copy at any time.
4. Prices, taxes and import charges
Prices are shown on the product page in the currency selected for your market and include any applicable statutory taxes shown at checkout. Delivery charges are shown separately and are calculated for your destination and your basket before you pay. What appears at checkout is the total you owe us.
4.1 European Union: orders of EUR 150 or less
For consignments to the EU with an intrinsic value of EUR 150 or less, we are registered under the Import One Stop Shop and we act as the collector of import taxes.
- Prices displayed to EU customers include destination country VAT at the rate of the delivery country.
- The flat customs duty of EUR 3 that applies to distance sales of goods to consumers in consignments up to EUR 150 is charged per commodity code, meaning per group of goods sharing the same six-digit Harmonised System heading, and not per physical item. Five identical parts on one commodity code carry one charge of EUR 3. Five parts on five different commodity codes carry five. We collect this duty at checkout inside the delivery price, and on some services it is already included in the carrier's own freight charge. On UPS Express it is not collected at checkout: UPS collects it from you on delivery.
- Because we pay these amounts to the tax authority on your behalf under our IOSS registration, the carrier should not ask you for anything on delivery, apart from the EUR 3 duty on a UPS Express delivery. If a carrier asks you for any other import VAT or duty on an order of EUR 150 or less, do not pay it. Send us the paperwork at contact@evparto.com and we will resolve it and reimburse you for anything you have already paid.
4.2 European Union: orders above EUR 150
The Import One Stop Shop cannot be used above EUR 150. For those consignments:
- The price you pay us is exclusive of import VAT and customs duty. The checkout page states this.
- You are the importer of record. Import VAT, customs duty and the carrier's own customs clearance or disbursement fee are collected from you by the carrier on or before delivery. These are charges of your own country, levied on you, not charges we receive.
- We declare goods honestly at the price actually paid. We do not under-declare, we do not mark goods as gifts or samples, and we will not do so on request.
- The EUR 150 threshold applies to the whole order, also when it travels as several parcels, and we do not split an order to bring it under that threshold.
4.3 United Kingdom
UK orders are placed through checkout once the goods in the basket, delivery excluded, are above £135. At or below £135 UK law requires the seller to charge UK VAT when the goods are sold, and we are not registered for UK VAT, so checkout does not open for those baskets: you can add parts, or ask us for a delivered price by quote. Above £135 the normal UK import rules apply and import VAT and customs duty are due when the goods enter the UK. With the postal delivery options they are collected from you on delivery by Royal Mail or the carrier, together with its handling fee. With UPS we prepay them to the carrier for you: the estimated amount is included in the delivery price shown at checkout, and nothing further is collected from you on delivery.
4.4 Everywhere else
For all other destinations the price is exclusive of import taxes unless the checkout page says otherwise for your country. Import VAT or sales tax, customs duty, excise, brokerage and clearance fees are assessed by your own authorities against you as importer of record and are payable by you. Rates and thresholds are set by your country and change without reference to us. If you refuse a consignment because you do not want to pay those charges, the rule on refused and undeliverable consignments in clause 14 applies.
4.5 Price changes and errors
The price that binds us is the price shown at the moment you place the order, subject to clause 15. We may change published prices at any time before an order is placed. A change after your order does not affect a contract already formed by dispatch confirmation.
5. Payment
We accept the payment methods shown at checkout. Payment is taken in full when you order, and is a condition of dispatch. Card payments are processed by our payment providers under their own security standards. We do not receive or store your full card number.
- Where your bank requires strong customer authentication, the order cannot proceed until you complete it.
- If a payment is reversed, charged back or fails after dispatch, the amount becomes immediately due and title in the goods does not pass to you under clause 7.
- If your card is charged in a currency other than the currency of your account, your bank may apply its own conversion rate and a foreign transaction fee. That is a matter between you and your bank.
- Business customers do not have a credit account unless we have agreed one in writing. Where we have, invoices are payable within the agreed term, and we may charge statutory interest and recovery costs on late payment under the law applicable to that agreement.
6. Delivery
We dispatch from Hong Kong. Delivery times, carriers, lanes and any weight or size limits that apply to your destination are set out in our Shipping and Delivery policy, which forms part of these terms.
- Estimated delivery times are estimates, not guarantees, unless we have expressly guaranteed a date in writing for your order.
- Where you are a consumer and we have not agreed a delivery date, we will deliver without undue delay and in any event within 30 days of the day the contract is formed. That is the position under Article 18 of Directive 2011/83/EU and the equivalent rules in other markets.
- If we miss that period, you may give us a reasonable additional period. If we fail to deliver within it, you may cancel and receive a full refund of everything you have paid, including delivery. Where the delivery period was essential to you, and you told us so before ordering, or it is obvious from the circumstances, you may cancel straight away.
- Delivery is complete when the goods are handed to you or to a person at the delivery address, or left in a place you have instructed the carrier to use.
- You must give a complete and accurate address, a working telephone number and an email address. Costs caused by a wrong or incomplete address, including redirection, return to sender and re-dispatch, are yours.
- Some destinations require your tax identification number, personal identification number or customs registration for import clearance. If you do not supply it when asked, the consignment cannot clear, and the rule on refused and undeliverable consignments in clause 14 applies.
- We are not liable for delay caused by an event outside our reasonable control as described in clause 24.5, but we will tell you and, if the delay becomes substantial, you may cancel the undelivered part and be refunded.
7. Risk and title
- Consumers. Risk of loss or damage passes to you when you, or a person you have named other than the carrier, take physical possession of the goods. Where you arranged the carriage yourself and we did not offer that carrier, risk passes when the goods are handed to your carrier. This reflects Article 20 of Directive 2011/83/EU.
- Business customers. Risk passes when the goods are handed to the first carrier in Hong Kong.
- Title. Legal and beneficial ownership of the goods stays with us until we have received payment in full and cleared funds for those goods and for any other sum you owe us. Until then a business customer holds the goods as bailee, stores them so that they remain identifiable as ours, and must not pledge or charge them.
Nothing in this clause affects your rights if goods arrive damaged. See clause 12 and our Returns and Refunds policy.
8. Identifying the part
We match parts by the vehicle manufacturer's original equipment number. That number is the identifier we sell against, and it is the safest way to buy a replacement part.
What this means in practice:
- We hold catalogue references and match your number to them. We do not build parts, and we do not go out and find a part to order against a description.
- Vehicle, model, year and engine information on our pages is a guide to help you find the right number. It is compiled from manufacturer catalogue data and is not a guarantee of fitment on its own.
- Manufacturers change specifications within a model year and within a market. Two vehicles that look identical can take different parts.
- Check the number on the part you are replacing, or ask your workshop or a franchised dealer to confirm the number for your vehicle identification number, before you order. If you order against a number you have confirmed and we ship a part that does not carry that number or does not correspond to it, that is our error and clause 12 applies, with return carriage at our cost.
- If you order against a number that turns out to be the wrong number for your vehicle, the part is not faulty. Your options are the change of mind route in clause 11 if you are a consumer within the period, or the voluntary 30 day return in clause 11.4, in both cases with return carriage at your cost.
Ask us before you order if you are unsure. Send the vehicle identification number and a photograph of the old part to contact@evparto.com and we will tell you what our catalogue data shows. That is help, not a warranty of fitment, unless we confirm fitment expressly and in writing for your vehicle identification number.
9. Product information and dimensions
- Photographs, drawings and renderings are illustrative. Colour reproduction varies between screens. Small differences in finish, marking, connector colour or supplier packaging are normal and are not a defect.
- Dimensions and weights shown on consumer pages are approximate packaging dimensions and a weight band, given to help you judge handling and shipping. They are not engineering specifications and must not be used to establish fitment. Where an exact dimension matters, ask us in writing.
- Technical data, fitment tables and cross references are drawn from manufacturer catalogue sources. We correct errors when we find them. Data of this kind is offered in good faith and is not a specification we warrant, except where we confirm a specific value to you in writing for your order.
- Where a part is described as an aftermarket alternative, it is made by a manufacturer other than the vehicle manufacturer to fit the same application. Where a part is described as original or genuine, it carries the vehicle manufacturer's own part number and marking.
- Fitting a vehicle part is skilled work. Unless you are competent to do it, have the part fitted by a qualified technician, and follow the vehicle manufacturer's torque figures, sequences and safety procedures. Damage caused by incorrect fitting is not a defect in the part.
10. Parts we cannot ship
Some vehicle parts are classified as dangerous goods for transport. Airbag modules and inflators, seatbelt pretensioners, and gas-charged struts, dampers and accumulators fall into this group, along with certain items containing pressurised gas or pyrotechnic charges.
- No carrier lane currently available to us from Hong Kong will accept these items. We therefore do not sell them at checkout. They are shown as inquiry-only, with no add to basket, and they carry a note explaining why.
- Items containing lithium cells, including certain key fobs and tyre pressure modules, are subject to transport rules and to national battery registration rules. We may restrict these to inquiry-only in some markets.
- If an item you have ordered is later found to be in one of these categories, we will not dispatch it. We tell you, we refund it in full, and if you wish we treat it as a quote request instead.
- Weight, size and value ceilings apply on individual carrier lanes. If your basket cannot be carried to your destination within those ceilings, checkout will not offer a shipping rate. Ask us and we will quote a route if one exists.
We would rather tell you at the product page than take your money and fail at the loading dock.
11. Changing your mind
This clause applies to consumers. Business customers have no right of withdrawal, see clause 16. The voluntary 30 day return in clause 11.4 applies to business customers too.
11.1 The statutory right
If you are a consumer in the European Union, the European Economic Area or the United Kingdom, you may withdraw from the contract within 14 days without giving any reason. This is the right given by Articles 9 to 16 of Directive 2011/83/EU, and in the United Kingdom by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Consumers in other countries have the rights their own law gives them, which our Your Rights by Country annex sets out.
The 14 days run from the day on which you, or a person you named other than the carrier, take physical possession of the goods. Where an order is delivered in several consignments, the period runs from possession of the last item.
11.2 How to withdraw
Tell us before the 14 days are up. Any clear statement is enough: an email to contact@evparto.com, or the form on our Withdraw from a Contract page, which contains the model withdrawal form. Give your order number, the items and the date of delivery. Sending the goods back without telling us first slows everything down and risks the parcel arriving with nothing to match it to. The deadline is met if you send your statement before the period expires.
11.3 What happens then
- Send the goods back without undue delay and in any event within 14 days of telling us. We give you a return authorisation and the return address, which is not a fixed address and depends on your location.
- You bear the direct cost of returning the goods on a withdrawal. We tell you this before you order because the law requires us to tell you before we can charge it. Bulky parts that cannot go by ordinary post have to come back by freight, which can cost considerably more than a parcel and, for the largest parts, several hundred US dollars. We confirm the exact cost with your return reference, before you send anything. Ask us about a discounted return label, which we can often arrange more cheaply than a retail counter.
- We refund everything you paid, including standard outbound delivery, without undue delay and in any event within 14 days of the day you tell us you are withdrawing. We may withhold the refund until we have received the goods back or you have supplied proof that you have sent them, whichever comes first. If you chose a more expensive delivery option than our standard one, we refund the standard cost.
- We refund using the same payment method you used, unless you agree otherwise. You pay no fee for the refund.
- You may handle and inspect the goods as you would in a shop. You are liable for any diminished value caused by handling beyond that. Fitting a part to a vehicle, connecting it electrically, cutting a cable, breaking a factory seal on a sealed electronic component, or discarding the packaging goes beyond inspection, and we may deduct the resulting loss of value from the refund. We tell you the amount and the reason before we deduct it.
11.4 Our additional 30 day return
On top of your statutory rights, and separately from them, we offer a voluntary 30 day return on unused parts in their original packaging. This is a contractual promise, it does not reduce anything above, and it is available to consumers and business customers everywhere we ship, including markets with no statutory cooling-off right.
- The 30 days run from delivery.
- The part must be unused, unfitted, unmarked and complete, in its original packaging with any seals intact.
- You bear the direct cost of return. Refunds under this voluntary right cover the price of the goods. Outbound delivery is refunded only where the statutory right in clause 11.1 also applies and you are within its period.
- We may decline a return under this voluntary right where the part shows signs of fitting or use. It is voluntary, so we set its conditions, and none of them touch clauses 11.1, 12 or 13.
11.5 Where withdrawal does not apply
The statutory withdrawal right does not apply to goods made to your specification or clearly personalised, and to sealed goods unsuitable for return for health or hygiene reasons once unsealed. We rarely sell either. Where an exception applies, the product page says so before you order.
12. Faulty goods
If goods do not conform to the contract, you have remedies. For consumers those remedies come from your own national law, and this clause does not replace them. In the EU the baseline is Directive (EU) 2019/771 on the sale of goods, implemented in each member state. In the United Kingdom it is the Consumer Rights Act 2015. Country detail is in the Your Rights by Country annex.
Goods do not conform if they are not of the description, type, quantity or quality agreed, are not fit for the purpose you told us about and we accepted, do not have the qualities of a sample or model shown to you, or are not fit for the purposes for which goods of that type are normally used.
12.1 What you get
- Repair or replacement, free of charge, within a reasonable time and without significant inconvenience to you. You choose between the two unless the one you choose is impossible or would impose disproportionate costs on us.
- If repair or replacement is impossible, is not done within a reasonable time, is not done without significant inconvenience, or the defect appears again, you may have a price reduction or you may end the contract and get a refund. You may go straight to these where the defect is serious, where we have refused to bring the goods into conformity, or where the circumstances make it clear that we will not do so.
- Refunds are made without undue delay and in any event within 14 days of the day you tell us you are ending the contract. Where the goods are to come back to us, we may wait until we have received them or proof that you have sent them, and the return is at our cost.
Some national laws add remedies, such as the short-term right to reject in the United Kingdom, or the immediate right to a refund on a major failure in Australia. Those apply on top of this clause where they apply to you.
12.2 Damage in transit and missing items
Check the consignment when it arrives. Tell us within 7 days of delivery if the goods arrive damaged, if an item is missing, or if the outer packaging is visibly damaged, and send photographs of the parcel, the label and the goods. That period is a request that helps us claim against the carrier, and it is not a condition of your statutory rights, which run for their full statutory period whatever happens. If you tell us later, we still deal with it.
12.3 Costs
Where goods are faulty, damaged or not what you ordered, we pay return carriage, and we bear the cost of repair, replacement and refund. You never pay to send back something that was wrong when it reached you.
12.4 What is not a defect
Fair wear and tear, damage from an accident, damage from incorrect fitting, whoever carried it out, damage from continued use after a fault appeared, modification, use in an application the part is not made for, use of the wrong fluids or consumables, corrosion caused by the environment, and consumable items reaching the end of their normal service life are not defects. Nor is a part that is in perfect condition but is the wrong number for your vehicle, which clause 8 covers.
13. The 24-month guarantee
We give a commercial guarantee of 24 months against defects in material and workmanship, running from the date of delivery. It is offered by Dragon Wagon Export Limited at the address in clause 1, it is free of charge, and it applies to every part we sell at checkout, in every country we ship to.
This is a voluntary guarantee under Article 17 of Directive (EU) 2019/771. It is in addition to your statutory rights. By law you are entitled to have goods that do not conform put right by us free of charge, and this guarantee does not affect that right. It does not restrict your statutory rights, it does not replace them, and using it does not stop you from also relying on them. Your statutory rights last at least 2 years from delivery, and longer where your country's law gives more: for example 3 years in Spain, Portugal and Sweden, each with a 2-year period in which a fault is presumed to have existed at delivery; 5 years in Norway for goods meant to last; up to 6 years to bring a claim in Ireland and the United Kingdom; and no fixed limit in the Netherlands and Finland. Where your statutory rights give you more than this guarantee, they apply. The Your Rights by Country annex has the detail.
What the guarantee gives you. If a part fails within 24 months because of a defect in material or workmanship, we will repair it, replace it, or refund it, at our option after examining it, and we pay carriage in both directions. Where your country's law presumes a fault existed at delivery for less than 24 months, we do not ask you, for the rest of the 24 months, to prove that the defect existed at delivery.
How to claim. Email contact@evparto.com with your order number, the original equipment number, the date of fitting, the vehicle's mileage or hours at fitting and at failure, a description of the failure, and photographs. We will issue a return authorisation and a return address. Keep the failed part. Do not scrap it, because we usually need to examine it.
What the guarantee does not cover. Everything listed in clause 12.4, plus parts fitted to vehicles used in competition, parts fitted outside the manufacturer's specified application, and consequential costs. Labour for removal and refitting, diagnostic time, recovery, hire vehicles and loss of use are not covered by this voluntary guarantee. Where your national law gives you a right to some of those costs as part of a statutory conformity remedy, that right is unaffected: clause 17 sets out how that works.
Proof. Keep your order confirmation. We can also look your order up from the email address used.
14. Returns
Our Returns and Refunds policy sets out the process in full and forms part of these terms. The core rules are these.
- Always ask for a return authorisation first. Email contact@evparto.com. We will issue an authorisation number and the return address.
- The return address is not fixed. It is issued with the authorisation and depends on where you are, so that your return travels the shortest sensible distance. Do not send goods to our registered office. Goods sent to an address we did not give you may be refused or may be untraceable, and we cannot take responsibility for them.
- Who pays. We pay return carriage where the part is faulty, damaged in transit, or not what you ordered. You pay the direct cost of return where you have changed your mind, where you exercise a statutory withdrawal right, where you use our voluntary 30 day return, or where you ordered the wrong number. We pay return carriage in no other case, unless the law of your country puts it on us.
- Condition. Pack the part so it arrives as it left. Use the original packaging inside an outer box. Do not write on or tape the part's own box. A part damaged by poor return packing may be refunded at a reduced amount, and we will tell you why.
- Refund timing and method. Refunds are issued to the original payment method. On a statutory withdrawal we refund within 14 days of the day you tell us you are withdrawing, and we may withhold the refund until we have the goods back or proof that you sent them, whichever comes first. On our voluntary 30 day return we refund within 14 days of receiving the goods back. For faulty goods, clause 12.1 applies. Your bank or card scheme controls when the money appears on your statement, which is usually a few days later.
- Refused and undeliverable consignments. Refusing a delivery, or leaving it uncollected, is not by itself a withdrawal. If you refuse delivery, do not pay import charges you owe as importer of record, or do not collect a consignment held for you, the goods come back to us and you bear the cost of that return. We pay the carrier and deduct the cost from your refund. Unless you have withdrawn under clause 11, we also deduct the original outbound carriage and any storage, duty or destruction charge the carrier or a customs authority passes to us. If you have told us within the withdrawal period that you are withdrawing, clause 11.3 applies instead: you still bear the direct cost of the goods coming back, and we refund the standard outbound delivery. None of this applies where the goods are faulty, damaged or not what you ordered (clause 12.3), or where the charge you were asked to pay was one we should have collected under clause 4.1. In those cases we bear the cost.
- Import taxes on returns. Where you have paid import VAT or duty as importer of record and you then return the goods, we refund what you paid us. Reclaiming import taxes from your own customs authority is a claim you make against them, and we will supply the export and return documentation you need to do it.
15. Obvious errors
We publish thousands of parts and their data. Errors happen.
If a price, a specification, a stated quantity or an availability statement contains an error that is obvious and unmistakable, and could reasonably have been recognised by you as an error, we are not bound by it, even if we have sent an order acknowledgement. A price of EUR 4 for a part that sells everywhere at EUR 400 is an example.
Where this happens we will contact you before dispatch, tell you the correct position, and give you the choice of proceeding at the correct price or cancelling. If we cannot reach you, or you do not reply within a reasonable period, we treat the order as cancelled and refund you in full.
This clause does not let us change a price simply because we would rather have charged more, and it does not apply after dispatch confirmation to a price that was merely keen. It covers genuine error, and the burden of showing that an error was obvious sits with us.
16. Business customers only
This clause applies only where you buy in the course of a business. It does not apply to consumers, and nothing in it reduces any consumer right.
- You confirm that you are buying wholly for business purposes and that you are not a consumer. The consumer withdrawal right in clause 11.1 and the consumer conformity remedies in clause 12 do not apply to you. The voluntary 30 day return in clause 11.4 does apply to you, on its conditions: the part unused, unfitted, unmarked and complete in its original packaging, and return carriage at your cost.
- The implied terms as to correspondence with description, merchantable quality and fitness for purpose in sections 15, 16 and 17 of the Hong Kong Sale of Goods Ordinance (Cap. 26) are excluded to the fullest extent the law allows, subject to the reasonableness test in the Control of Exemption Clauses Ordinance (Cap. 71), which we accept applies to this exclusion.
- You must inspect goods on arrival and notify us of shortage, damage or non-conformity within 7 days of delivery, in writing, with photographs. After that period goods are deemed accepted, save for defects that a reasonable inspection would not have revealed, which must be notified within 7 days of discovery and in any event within 12 months of delivery.
- Our liability to a business customer for defective goods is limited, at our option, to repair, replacement, or a refund of the price paid for the goods in question.
- You may not resell our goods with any representation that you are an authorised dealer of any vehicle manufacturer, or in a way that suggests any association between us and a vehicle manufacturer. You must pass our fitting, safety and product information on to your own customer.
- You are responsible for your own compliance obligations in your market, including any registration for packaging, batteries and electrical equipment, and any obligation as importer of record.
- Risk passes on handover to the first carrier, per clause 7. Delivery dates for business customers are estimates and time is not of the essence unless we agree otherwise in writing.
- We may set off any sum you owe us against any sum we owe you. You may not.
- Sections 3 to 8 of the Hong Kong Control of Exemption Clauses Ordinance (Cap. 71) apply to this contract and nothing in this clause is intended to exclude liability that Ordinance does not permit us to exclude.
17. Liability
17.1 What we never limit. Nothing in these terms limits or excludes our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- gross negligence or intentional misconduct, including by our employees, agents or subcontractors;
- liability under product liability law, including Directive 85/374/EEC and its successor regime as implemented in your country, and the corresponding rules elsewhere;
- anything else which the law applicable to you does not allow to be limited or excluded, including your mandatory statutory conformity rights.
17.2 Ordinary negligence. Subject to 17.1, where we breach a material contractual obligation through ordinary negligence, our liability is limited to the loss that was foreseeable when the contract was made and is typical for a contract of this kind. A material contractual obligation is one whose fulfilment makes proper performance of the contract possible in the first place and on which you can normally rely. Subject to 17.1, we are not liable for ordinary negligence in breach of any other obligation.
17.3 Consumers. Subject to 17.1 and 17.2, and to your national law, we are not liable for loss that was not foreseeable when the contract was made. Because you buy as a consumer for private purposes, we are not liable for loss of profit, loss of business or loss of an opportunity. We are not liable for loss arising because you told us nothing about a special circumstance before the contract was made. Where a statutory conformity remedy in your country entitles you to the cost of removing a defective part and fitting a replacement, we pay that cost, because it is a mandatory element of the remedy.
17.4 Business customers. Subject to 17.1, our total liability arising out of or in connection with a contract, in contract, tort including negligence, misrepresentation, restitution or otherwise, is limited to the price paid for the goods giving rise to the claim. We are not liable to a business customer for loss of profit, loss of revenue, loss of contracts, loss of goodwill, loss of anticipated savings, wasted labour or workshop time, vehicle downtime, recovery costs, hire vehicle costs, or any indirect or consequential loss, however caused.
17.5 Fitting. We supply parts. We do not fit them, we do not supervise fitting, and we are not liable for damage caused by fitting done incorrectly or against the vehicle manufacturer's procedure, whoever carried it out. Where a defect in the part itself causes damage, that is a product liability question and 17.1 governs it.
17.6 Fitment data. Catalogue fitment data is a guide, per clause 8. Where you have ordered against a number rather than a fitment table, and the number was correct, we have supplied what you asked for.
17.7 Each part of this clause operates separately. If any part is held unenforceable, the others continue in force.
18. Governing law and jurisdiction
18.1 Governing law. These terms, each contract made under them, and any non-contractual obligation arising out of or in connection with them, are governed by the law of the Hong Kong Special Administrative Region.
18.2 The consumer protection that survives that choice. If you are a consumer habitually resident in a country whose law protects consumers by rules that cannot be derogated from by agreement, and we direct our commercial activity to that country, our choice of Hong Kong law does not deprive you of the protection of those mandatory rules. That is the effect of Article 6(2) of Regulation (EC) No 593/2008 (Rome I) for consumers in the European Union and the European Economic Area, and of equivalent conflict rules in the United Kingdom, Switzerland, Australia, New Zealand and elsewhere. In plain terms: Hong Kong law governs the contract, and every consumer right your own country gives you that cannot be contracted away applies to you anyway. Where the two differ, the more protective rule for you applies to the matter it covers.
18.3 Which courts. Where you are a consumer, you may bring proceedings against us in the courts of Hong Kong or in the courts of your own country of habitual residence, at your choice. We may bring proceedings against you only in the courts of your country of habitual residence. For consumers domiciled in the European Union this reflects Articles 17 to 19 of Regulation (EU) No 1215/2012, and we agree to it rather than argue about it.
18.4 Business customers. The courts of Hong Kong have exclusive jurisdiction over any dispute with a business customer, and the business customer submits to that jurisdiction.
18.5 The United Nations Convention on Contracts for the International Sale of Goods (Vienna, 1980) does not apply to contracts with business customers. For consumers, mandatory rules under 18.2 take precedence over this exclusion where they apply.
18.6 Language. These terms are concluded in English. Translations are provided for convenience. Where a translation and the English text differ, the English text governs, except where the law applicable to you as a consumer requires otherwise, in which case the version in your own language governs the point in dispute.
19. Export control and sanctions
Goods are exported from Hong Kong and may be subject to export control, re-export control and sanctions rules in Hong Kong, the People's Republic of China, the European Union, the United Kingdom and the United States, and to import controls in your own country.
By placing an order you warrant that:
- you are not a person, entity or vessel designated on any applicable sanctions or restricted party list, and you are not owned or controlled by, or acting for, such a person or entity;
- you are not ordering on behalf of, or for onward supply to, a person in a country or territory subject to comprehensive sanctions, and you will not re-export the goods to any such destination;
- the goods will not be used, directly or indirectly, in connection with any military end use, any nuclear, chemical or biological weapons programme, or any missile programme;
- you will comply with all export, re-export, import, customs and sanctions laws applicable to the goods after delivery;
- the information you give us for customs and screening purposes is accurate and complete.
We screen orders against sanctions lists. We may refuse or cancel any order, before or after acknowledgement, where screening returns a hit, where a licence would be required and has not been obtained, or where we reasonably believe an order breaches these rules. In that event we refund in full and we owe you nothing further. We may withhold delivery while we make enquiries and we may report matters where the law requires it. We do not currently ship to destinations we have suspended for legal or carrier reasons, and the checkout will not offer a rate for them.
20. Product safety
Parts are supplied for fitting to the vehicle applications identified by their original equipment number. Fitting a part to a vehicle it is not made for is dangerous.
- Safety-critical parts, including braking, steering, suspension, restraint and high voltage components, must be fitted by a qualified technician working to the vehicle manufacturer's procedure.
- High voltage components on electric and hybrid vehicles must be handled only by technicians qualified to work on high voltage systems. Isolate the system before work.
- Follow torque figures and tightening sequences. Replace single-use fasteners, seals and gaskets.
- Do not modify a part. Do not fit a damaged part. Do not fit a part that does not match the number you ordered against: tell us instead.
Under Regulation (EU) 2023/988 on general product safety, the responsible person in the Union for products we place on the EU market is Mario Zaccagnini, Calle de Ayala 112, 3B, 28006 Madrid, Spain, contact@evparto.com. That is the Article 16 economic operator you or an authority can contact about product safety, and the name and address appear on the relevant product pages and on our Product Safety page.
Where a product we supply carries a vehicle manufacturer's own part number, the manufacturer identified on the product page is BYD Company Ltd., with an EU contact at BYD Europe B.V., Schiedam, Netherlands.
Packaging. Regulation (EU) 2025/40 on packaging and packaging waste applies to goods we place on the EU market. Where we are required to appoint an authorised representative for packaging in a member state, we do so, and we restrict sales to member states where that appointment is in place. Details of national registrations are on our Packaging and Battery Take-back page, along with the return route for used batteries and packaging.
If you become aware of a safety problem with a part we supplied, stop using it and tell us at contact@evparto.com. If we identify a safety risk in a product we have sold, we will contact affected buyers using the details held for the order, publish a notice, and notify the competent authorities through the Safety Business Gateway or its national equivalent.
21. Catalogue rights and anti-scraping
Our catalogue is the product of substantial investment in obtaining, verifying and presenting data. It is protected, and we enforce that protection.
21.1 What is protected. The site, its structure, its text, its photographs, its illustrations, its category and part-type taxonomy, its cross-reference tables, its fitment tables, its translations, its descriptions and its compilation of original equipment numbers, together with the EVParto name, logo and get-up. Copyright and, in jurisdictions that recognise it, the sui generis database right under Directive 96/9/EC, belong to us or to our licensors.
21.2 What you may do. Browse the site. Search it. Print or save individual pages for your own use or to help you buy a part. Quote short extracts with attribution and a link.
21.3 What you may not do. Without our prior written consent, you must not:
- extract or re-utilise the whole or a substantial part of the contents of the catalogue, whether evaluated quantitatively or qualitatively, and you must not repeatedly and systematically extract or re-utilise insubstantial parts in a way that conflicts with our normal exploitation of it;
- use any robot, spider, scraper, headless browser, harvesting script or automated process to access, copy, monitor or index the site, other than a search engine crawler obeying our robots file;
- copy our fitment data, cross-reference data, taxonomy, translations or descriptions into another catalogue, feed, marketplace listing, application or dataset;
- use our content to train, fine-tune or evaluate a machine learning model, or to build any competing product data set;
- circumvent rate limiting, access controls or technical protection measures, or place a load on our systems that interferes with their normal operation;
- use the EVParto name or logo, or any confusingly similar sign, in a domain name, an advertisement, a marketplace shop name or metadata.
21.4 Enforcement. We monitor access patterns. We may block addresses, throttle traffic and terminate accounts without notice. We will pursue injunctive relief and damages for breach of this clause, and we treat systematic scraping as a matter for the courts rather than a matter for correspondence.
21.5 Third party marks. Vehicle manufacturer names, model names and original equipment numbers belong to their owners. We use them descriptively to say which vehicle a part fits. That use does not imply any approval, sponsorship or affiliation, and we make no claim to those marks.
22. Complaints
If something has gone wrong, tell us and we will fix it. Complaints go to contact@evparto.com with your order number and what happened.
- We acknowledge a complaint within 24 hours, usually sooner.
- We give a substantive answer within 14 days. If a complaint needs a technical examination of a returned part, we tell you that and give you an expected date.
- If you are not satisfied with our answer, say so and it will be reviewed by our management.
Alternative dispute resolution. We are not obliged to take part in dispute resolution proceedings before a consumer arbitration body, and we do not undertake to do so. The European Commission's Online Dispute Resolution platform no longer exists: it stopped accepting complaints on 20 March 2025 and closed on 20 July 2025 under Regulation (EU) 2024/3228, and there is no successor platform. Any site still linking to it is linking to nothing. If your country has a national consumer body or ombudsman you may approach, you are free to do so, and your right to go to court under clause 18.3 is unaffected.
23. Changes to these terms
We may change these terms. The version that governs your contract is the version published on this site when you placed your order, and a later change does not apply retrospectively to a contract already formed.
Changes take effect when published. Where a change is material and affects an ongoing arrangement with a business customer, we give 30 days' notice by email. We keep previous versions and will send you the one that applied to your order on request. Each version carries a version number and a date at the top of this page.
24. General
24.1 Severability. If any provision of these terms is found to be invalid, unlawful or unenforceable, it is severed to the minimum extent required and the remaining provisions continue in full force. Where a provision would be valid if part of it were deleted or its scope reduced, it applies with that modification.
24.2 Mandatory law prevails. Where any provision conflicts with a mandatory rule of the consumer law applying to you, that rule prevails over the provision, the provision is treated as modified to the extent needed to comply, and the rest of these terms are unaffected.
24.3 No waiver. A delay or failure to enforce any right is not a waiver of it, and no single or partial exercise of a right prevents its further exercise.
24.4 Assignment. We may assign or transfer our rights and obligations to another entity, and we will tell you if we do. Your rights are not affected. You may not assign your rights without our written consent, except that a consumer may transfer the benefit of the guarantee in clause 13 with the goods.
24.5 Events outside our control. We are not in breach for a failure or delay caused by an event beyond our reasonable control, including war, civil unrest, terrorism, epidemic, natural disaster, fire, flood, extreme weather, port or airport closure, carrier failure, industrial action, embargo, sanction, government act, failure of public telecommunications or power, and cyber-attack. We tell you promptly, we do what we reasonably can to limit the effect, and if the event continues for more than 30 days either of us may cancel the affected part of the order with a full refund of anything paid for it.
24.6 Third party rights. A person who is not a party to a contract made under these terms has no right to enforce it under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) of Hong Kong or any equivalent legislation.
24.7 Entire agreement. These terms, together with the policies they incorporate, the order confirmation and any written quote we have issued, are the whole agreement between us for the goods ordered. This does not exclude liability for fraudulent misrepresentation, and it does not exclude a consumer's right to rely on statements made to them before the contract, including in a product description or an advertisement.
24.8 Notices. Notices to us go to contact@evparto.com or to the registered office in clause 1. Notices to you go to the email address on your order. Email notices are treated as received on the day after sending unless a delivery failure is received.
24.9 Incorporated policies. Our Shipping and Delivery policy, our Returns and Refunds policy, our Privacy Policy, our Your Rights by Country annex and our Legal Notice form part of these terms.
